This is the first bail application filed under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 62/2025 registered at Police Station- Excise Circle Sankra, District - Mahasamund (C.G.), for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act. 2. As per the prosecution story, the police received secret information from an informant that, on the date of the incident, an unknown person was in possession of illegal liquor intended for sale. Acting on PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.09.11 17:49:02 +0530 2 this information, the police seized 22.520 bulk litres of country-made kachchi Mahua liquor from an open place at the scene of the incident. The person in possession failed to produce any valid documents for the seized liquor. Consequently, a case was registered against the applicant under Section 34(2) of the Excise Act. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant has one previous criminal antecedent registered in Crime No. 99/2022 under the Excise Act in which the applicant has been acquitted. He also submits that the charge-sheet has been filed in the present case and the applicant is in jail since 17.07.2025. It is further argued by him that under Section 34(2) of the C.G.
