Heard Mr. M. L. Nongpiur, learned Counsel appearing for the petitioner also Mr. R. Gurung, learned GA appearing for the State- respondents.
By this application under Section 5 of the Limitation Act 1963, the petitioner has sought for condonation of 73 days in preferring the appeal against the judgment and order dated 30-09-2024 passed by the Learned 2025:MLHC:60
Special Judge, POCSO, Shillong, East Khasi Hills District in Special (POCSO) Case No. 45 of 2019.
The reasons for delay have been satisfactorily explained in paragraphs 4 & 5 of the application.
Mr. R. Gurung, learned GA appearing for the State-respondent does not have any serious objection to the prayer for condonation of delay.
In view of the above, the delay of 73 days in preferring the connected appeal against the judgment and order dated 30-09-2024 passed by the Learned Special Judge, POCSO, in Special (POCSO) Case No. 45 of 2019 is hereby condoned.
The application stands allowed.
