ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer: a. “A Writ/order/direction in the nature of certiorari and may kindly be pleased to quash the order of suspension dated.
17-11-2025 bearing No.SANKE.EV/ETARE/47/UWA/2025 which suspended the petitioner from rendering his services as CPI Athani circle, Belagavi passed by Respondent No.2 produced at Annexure-D, in the interest of justice and equity. b. any other writ or direction or order the petitioner is found entitled to in the ends of justice.”
2. The petitioner is an employee of the Home Department, and any order passed by the Home Department should undoubtedly be challenged before the Karnataka State Administrative Tribunal.

Learned counsel for the petitioner submits that the impugned order is wholly without jurisdiction and therefore this Court should entertain the petition. However, the same submission can be made before the Karnataka State Administrative Tribunal as well.
4. Inasmuch as the Tribunal is the Court of first instance, as held by the Seven-Judge Bench of the Hon’ble Apex

Court in L. Chandrakumar Vs. Union of India1, the petitioner has an efficacious remedy before the Tribunal.
5. In that light, the petition stands disposed of, directing the petitioner to avail the remedy of approaching the Karnataka State Administrative Tribunal.
