Mr. Chanchal Jain, learned counsel for the petitioner and Mr. P.C. Sinha, learned counsel for the respondents, are present.
Instant writ petition has been filed under Article 226 of the Constitution of India for quashing of Memo No. 1107 dated 28.04.2014 passed by respondent no. 4, whereby and whereunder, Rs.2,65,869/- has been recovered from the pension and gratuity of the petitioner on the ground of non-passing of Hindi Reading and Writing examination within one year from the date of appointment.
Learned counsel for the petitioner appears and submits that the cause of action does not survive, as the payment has already been made.
Under the circumstance, this writ petition stands disposed of in terms of the settlement arrived at between the parties.
