MD SALEEM (SC MC RSEEMA SPSR NLR) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…..to issue an appropriate Writ, Order or Direction, more particularly one in the nature of writ of mandamus, declaring the action of the respondents in not releasing gratuity and leave encashment of Rs.17,61,738/- is unconstitutional, violation of natural justice and consequently direct the respondents to release the gratuity and leave encashment of Rs.17,61,738/- with interest @ 24% per annum from 01.11.2017 till date immediately and pass such other order or orders…...” 2 2. Learned Standing Counsel for respondents 1 and 3 would submit that the respondent authorities have released the retirement benefits and the petitioner has received Rs.18,17,655/- towards gratuity and encashment of earned leave for 300 days vide stamped receipt dated 20.10.2018. 3. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 4. In that view, the Writ Petition is disposed of, since the petitioner has received the amount as per his claim. There shall be no order as to costs.
