JUSTICE SURAJ GOVINDARAJ) 1. The petitioners are before this Court seeking for the following reliefs: A. Issue a writ in the nature of certiorari to set aside the impugned order passed by the 2nd respondent in Rev Appeal No. 105/2008-09 dated 30.09.2020 vide Annexure-E, insofor petitioners concerned. B. Issue such other writ or order and directions as this hon ble court deems fit under the facts and circumstances of the case and allow this writ petition in the interest of justice and equity. 2. This is a rather strange case where the Deputy Commissioner has assumed the jurisdiction of the Taluka Regularization Committee and decided on the powers of the Committee and whether a land could be regularized by the committee or not. 3. The petitioners had made an application for regularization of the possession of their lands, which the Tahasildar having submitted a report, the Assistant Commissioner in Case No.Rev/250/2010- 11, vide its order dated 10.05.2011 directed the - 14 - HC-KAR NC: 2025:KHC-D:9264 WP No. 107806 of 2024 Tahasildar, Sandur to place the application of the petitioners herein before the Taluka Regularization Committee. Aggrieved by the same, certain others had filed an appeal before the Deputy Commissioner challenging said order. It is in these proceedings that the petitioners had filed an impleading application. The Deputy Commissioner, vide his impugned order dated 30.09.2020 had come to a conclusion that none of the impleading applicants and the appellants were cultivating the subject lands and dismissed the appeal by directing the Tahasildar, Sandur to immediately hand over the lands to the SLAO or KIADB Davangere to develop SEZ industrial layout to enable the Government to utilise the said land for future industrial use. 4. The Deputy Commissioner vide the impugned order had taken into consideration the report submitted by the Tahasildar that the land was a Gudda (hillock) and had not been cultivated and as such under Rule - 15 - HC-KAR NC: 2025:KHC-D:9264 WP No. 107806 of 2024 108(i) of the Karnataka Land Revenue Rules, 1966, wherein lands were prohibited from being granted to anybody and on that ground held the order of the Assistant Commissioner to place the applications submitted by the appellants or the impleading applicants before the Talukka Regularization Committee to be bad in law. 5. A perusal of the Rule 108(i) of the Karnataka Land Revenue Rules would indicate that the same applies to lands which are assigned for special purposes under Section 71 of the Karnataka Land Revenue Act and described in revenue records as devarakadu, urdupe, gunduthope, tankpan, putkaravalla, and burial grounds and such lands, which in the opinion of the Government is required for public purpose and relates to grant of land. Rule 108(i) firstly does not relate to regularization or possession. Secondly, it relates to lands assigned for special purposes under Section 71 of the Karnataka Land Revenue - 16 - HC-KAR NC: 2025:KHC-D:9264 WP No. 107806 of 2024 Act. Section 71 of the Karnataka Land Revenue Act deals with the power of the Deputy Commissioner to set apart lands which are the property of the State Government and not in the lawful occupation of any person or aggregate of persons in any village or portion of village, for free pasturage for the village cattle etc., for any other public purpose and the lands assigned specifically for any such purpose shall not be otherwise used without the sanction of the Deputy Commissioner and that in the disposal of lands under Section 69, due regard shall be had to all such special assignees. 6. It is in the applications which had been filed by the petitioners and certain others that the Deputy Commissioner has sought to reserve the land for special purposes, namely the SEZ, without considering the regularization request. In fact, as observed supra, Rule 108(i) deals with lands not to be granted, so does Section 71. Neither of the said - 17 - HC-KAR NC: 2025:KHC-D:9264 WP No. 107806 of 2024 provisions relate to regularization of land and it is only the Taluka Regularization Committee which can consider the application filed for regularization and pass necessary orders, after examining the contentions raised and ascertain the facts in relation thereto. 7. In the present case, the Deputy Commissioner has assumed the jurisdiction of the Taluka Regularization Committee and passed orders which are not sustainable in law. 8. In that view of the matter, I pass the following: ORDER i. The writ petition is allowed. ii. A certiorari is issued.
