JUSTICE PRAVEER BHATNAGAR Order 17/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 11/2025 registered at Police Station Chauth Ka Barwara District Sawaimadhopur for the offence under Sections 318(4), 319(2), 303(2), 336(2) and 340(2) of BNS and Section 66D of IT Act and Section 13 of RPGO. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is contended that no incriminating material was recovered from the petitioner’s mobile and petitioner has not cheated anyone, the police officials have wrongly been implicated the accused petitioner in the present case of cheating. The accused-petitioner is in custody since 08.01.2025 and there is no criminal antecedents against the petitioner. Investigation against the petitioner is concluded and [2025:RJ-JP:2544] (2 of 2) [CRLMB-779/2025] further investigation/trial of the trial will take time, therefore his bail application may be allowed. Per contra, learned Public Prosecutor opposes the grant of bail application. Heard and perused the material available on record. Considering the fact that there are no criminal antecedents against the petitioner and further investigation/trial of the case will take time, therefore, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Kuldeep S/o Chiranji Lal, in connection with FIR No. 11/2025 registered at Police Station Chauth Ka Barwara District Sawaimadhopur shall be enlarged on bail he provided furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
