GP FOR HOME (AP) 3 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: …. to to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 2 to 4 in not taking up active investigation in FIR No.220 of 2019, dated 07.12.2019 registered against respondents 5 to 14 for the offences punishable under Sections 452, 323, 324, 506 r/w 34 of IPC 3(1)(r ),3(1)(S),3(1)(z),3(2)(va) and Section 3(1)(s) of Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989 on the file of 4th respondent by arresting the accused for the offences committed by them, as illegal, irregular, and amounts to non- discharge of legal obligation conferred under the provisions of Code of Criminal Procedure, 1973 and violative of Article 14 of Constitution of India and consequently direct the respondents 2 to 4 to conduct investigation and file charge sheet against respondents 5 to 14 in the said crime, by subjecting them to arrest on judicial remand and opening rowdy/history/suspect sheet against respondents 5 to 14……” 2. Heard Sri P.V.S.K.Chakravarthy, learned counsel for the petitioner and V.Farook, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the police are not concluding the investigation and a direction may be given to the police to conclude the investigation as expeditiously as possible. 4. Learned Assistant Government Pleader for Home would submit that t the Court may pass appropriate orders. 5. Considering the same, this writ petition is disposed of. However, the police are directed to conclude the investigation and file a report according to 4 law, if not filed so far within a period of two months from the date of receipt of copy of this order. There shall be no order as to costs.
