GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a writ of Mandamus or any other appropriate writ, order, or direction directing Respondents No. 1 and 3 to take immediate action on the Petitioners representation dated 22-01-2024, 06-02-2024, remove the illegal encroachment, and restore the municipal road/pathway and setbacks adjacent to the southern side of Ravi Teja Towers for lawful use, declare the sale of the encroached portion of the municipal road by Respondent No. 4 as illegal and void, and direct Respondents No. 2 and 3 to take appropriate legal action against Respondent No. 4. and consequently direct Respondents No. 2 and 3 to enforce the approved layout plan (B.A. No. 102/2005 dated 10-03-2005) and ensure the restoration of setbacks for the Petitioners property. and to pass such…” 2. The present writ petition is filed aggrieved by the inaction of the respondents in initiating action on the petitioner’s representation dated 22.01.2024 and 06.02.2024 wherein the petitioner has requested to remove the illegal encroachment and to restore the municipal road/pathway and setbacks adjacent to the southern side of Ravi Teja Towers. 3. Heard learned counsel for the petitioner and learned counsel appearing for the respondents. 4. Today when the writ petition came up for hearing, learned Standing Counsel on oral instructions has informed this Court that they are initiating steps to pass appropriate orders on the representations made by the petitioner on 22.01.2024 and 06.02.2024 requesting to remove the illegal encroachments and restore the municipal road/pathway and setbacks adjacent to the southern side of Ravi Teja towers for lawful purspose. 5. Recording the said submission, instead of keeping the writ petition pending, this Court feels it appropriate to dispose of the writ petition by directing the respondent authorities to dispose of the representations dated 22.01.2024 and 06.02.2024 made by the petitioner, within a period of four (4) weeks from the date of receipt of a copy of this order, after duly conducting an enquiry in accordance with law. 6. Accordingly, with the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
