17.12.2025. It appears from the record that this Court had disposed of two bail petitions by a common judgment. One petition was filed seeking regular bail and the other petition was filed seeking pre-arrest bail. Due to a clerical error, the regular bail was not mentioned in the order and only pre-arrest bail was mentioned. The copy of the order shows that it had proceeded on the basis that the victim had resiled from her statement and stated before the learned Magistrate that she had left her home voluntarily and that no person was responsible. Therefore, no case was made out for kidnapping or rape. This finding applies to both regular bail as well as pre-arrest bail. Accordingly, the present application is allowed, and the words “ and regular bail” after the words “pre-arrest bail” and after the words
“Investigating Officer” “and learned Trial Court” in
Paragraph No. 11 are ordered to be added. The present application stands disposed of. The necessary correction be made and, after making the necessary correction, the petition be uploaded again on the official website of the High Court.
