Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is not the principal accused in this case. She was allegedly present when the interviews in question were taking place.
Learned counsel appearing on behalf of the State relying on the case diary and strongly opposes the prayer for anticipatory bail. The petitioner and other accused were arranging for interviews to send certain workers abroad, although no foreign entity had actually contacted them for doing so. First, the petitioner was present at the time of interviews were taking place. Secondly, the premises in question was licensed in the name of the present petitioner. The victims had clearly taken the name of the present petitioner as one of the miscreants who was organizing the interview. The petitioner was in close touch with his accomplices like Patrick Nayer, a person who was convicted in the US for having links with the terrorist
2 organization, Hizubul Mujahideen. The anticipatory bail of a co- accused was earlier rejected by this Court.
Considering the serious nature of allegations and the incriminating materials available in the case and the fact the anticipatory bail application of a co-accused was rejected by this Court earlier, I do not consider this to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
