This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.244/2024 registered at Police Station- D.D. Nagar Distt.- Raipur (C.G.), for the offence punishable under Section 294, 506-B, 323, 307, 34 of IPC.

2 Raipur near BSUP Colony, Sheetala Mandir with his wife Seema Tandon. At that time, sister-in-law of Gangaram, Mamtaj Masih & Basanti were fighting over the issue of water from the tank falling in Basanti House. Hearing the sound of quarrel, accused Bablu & Gujjar @ Roshan came and seeing the applicant, Seema Tandon started abusing in filthy & obscene language. Hearing this, husband of Seema Tandon, Gangaram came out of the house and objected abusing, in counter the accused abused him and threatened to kill him, thereafter with the intention to kill, accused Gujjar hit Gangaram on the left side of his chest with his fist and a knife, which he was carrying. Applicant Bablu Dhruw also beat him by his fist. On the report of Seema Tandon, crime was registered in Police Station D.D. Nagar, Raipur as Crime No. 244/2024 under section 294, 506-B, 323, 307, 34 of I.P.C. and investigation was taken up. It is alleged that during the investigation, accused Gujjar was arrested on 08.06.2024 and a knife was seized from him and section 307 of I.P.C. was added and accused Bablu Dhruw was arrested on 10.06.2024. After investigation, the charge sheet was presented in the Court.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and the allegation levelled against the present applicant is that he assaulted the injured with his hands, fist and knife but only single blow by knife over the injured body, which was not life threatening. He later submits that the applicant has three criminal antecedents and all are pending for its conclusion and he is in jail since 08.06.2024 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 3

On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court and submits that the applicant has three criminal antecedent. He further submits that on the date of incident applicant abused the injured, thereafter with the intention to kill him, applicant attacked with his fist and a knife on the left side of injured chest, as a result injured sustained grievous injuries caused by knife on his chest and as per medical report injured incised wound over the anterior chest wall, which is dangerous to life therefore, he is not entitled for grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature and gravity of offence levelled against the applicant and the fact the injured sustained grievous heart/chest injuries caused by sharp weapons and fist and during the investigation, statements were recorded from the injured, applicant assaulted the injured with sharp edged weapon (knife) on his chest and he suffered injuries which was found to be grievous in nature and dangerous to life, this Court does not find it a fit case to release the applicant on bail. 7. Accordingly, the bail application of the applicant- Gujjar Dhruw @ Roshan, involved in Crime No.244/2024 registered at Police Station-D.D. Nagar Distt.- Raipur (C.G.), for the offence punishable under Section 294, 506-B, 323, 307, 34 of IPC is rejected. 4
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance.
