2/20.12.2025 Heard learned counsel appearing on behalf of Petitioners and
learned counsel appearing on behalf of the State.
2. The petitioners are apprehending their arrest in connection with Manjhiaon P.S. Case No.- 67/2025, registered under sections 103(1), 238, 221, 132, 352 and 3(5) of BNS., pending in learned court of ACJM, Garhwa.

Learned counsel appearing for the petitioners submit that the petitioners are the villagers of same village from where Chanchala Kumari-deceased has found to be dead due to hanging. He submits that false allegation is made against of protection of not allowing of taking body for postmortem. He next submits that the father and mother and

villagers have been made accused. He submits that in the FIR itself, it is stated that the girl was in relationship with a boy and therefore she has hanged herself.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there against the petitioner No.1 of killing the girl.
5. On query made by the Court, learned counsel appearing for the State submits that the petitioners happen to be villagers. He also submits that parents of the girl have not been made accused.
6. Considering that these petitioners are the villagers and there are general and omnibus allegations against all the accused petitioners, the protest of not taking the body for post-mortem has been denied, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners above named are directed to surrender before the learned Court within four weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned ACJM, Garhwa, in connection with Manjhiaon P.S. Case No.- 67/2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita,

8. This Anticipatory Bail Application is accordingly allowed and
disposed of.
