By way of present writ petition, the petitioner is not challenging any specific order passed by the respondent authorities, instead, the petitioner respectfully seeks a direction from this Court to issue appropriate orders to the respondent authorities, thereby directing them to consider his case and allot him the vacant Government quarter No. G-21/1 situated in the Block Colony, Janjgir in accordance with law, as Digitally signed by JYOTI JHA Date: 2025.08.20 11:04:03 +0530 2 has been done in the case of a similarly situated employee. 2. Learned counsel for the petitioner submits that the petitioner is currently residing in government quarter which is in a dilapidated and uninhabitable condition. The structure of the quarter is severely deteriorated, with issues such as leaking roofs, damaged flooring, poor sanitation. Thereby making it unsafe and unsuitable for residential use. The petitioner is a heart patient and he had been gone through an open-heart surgery (Annexure-P/1). He requires a clean, stable, and stress-free living environment for his wellbeing and medical condition. Continued residence in the present quarter poses a serious risk to his health and safety. Moreover, it is essential for the petitioner to reside in a location that is near to hospital and a market, so that he can access medical care and daily necessities without undue hardship or delay, the current accommodation not only fails to meet these essential requirements but also puts his health at serious risk. The inaction of the respondent authorities causing immense hardship and health risks to the petitioner, violating his fundamental right to life and dignity under Article 21 of the Constitution. Hence this petition. 3. Learned counsel for respondents submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent-authorities to consider the pending application/ representation, he is having no objection to the limited prayer and if the application of the petitioner is pending, the same shall be considered in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 3 5. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent-authorities to consider/decide the representation of the petitioner (Annexure P-02) on its own merits in accordance with law as expeditiously as possible. 6.
