For Respondent(s) : HON'BLE MR. JUSTICE SAMEER JAIN Judgment 03/10/2025 The present petition is filed on the ground that the petitioner has filed a suit in the year 2012 seeking partition/rectification of records and a permanent injunction. [2025:RJ-JP:40141] (3 of 3) [CW-15126/2025] Learned counsel for the petitioner submits that due to the non-appearance of substantial respondents, ex-parte proceedings were initiated in the year 2014 and 2020. It is further submitted that the matter has been pending for over thirteen years, and the pleadings are completed. However, due to the ex-parte proceedings and despite numerous adjournments, the proceedings remain inconclusive. It is argued that in accordance with Article 14 of the Constitution of India and the provisions of Code of Civil Procedure, a speedy trial should be ensured and not more than three adjournments should be granted. In view of the above, this Court deems it appropriate to dispose of the present petition with liberty to the petitioner to file an application reiterating the above grounds before the concerned Civil Court; who shall consider the application and pass appropriate orders to adjudicate the matter, promptly. Accordingly, the present petition is disposed of. Pending applications, if any, also stand disposed. (SAMEER JAIN),J CHANDAN /17
