[2025:RJ-JP:46466] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 14965/2025 Dharmendra S/o Sh. Ram Swaroop, Aged About 29 Years, R/o Ward No. 2, Sansiyon Ka Mohalla, Luniawas, Police Station Kishangarh Renwal, District Jaipur Rural. (At Present Lodged In District Jail, Sikar) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Vivek Goyal For Respondent(s) : Ms. Manju Dave, PP HON’BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 18/11/2025 1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.144/2023 registered at Police Station Sadar Sikar, District Sikar for offence under Sections 8/20 and 25 of NDPS Act. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that persons whose names have been mentioned in the FIR and from whom alleged contraband has been recovered i.e. Hanuman and Guddu have been enlarged on bail by the co-ordinate bench of this Court on 15.02.2024. It is argued that allegation of supply of the contraband has been levelled against co-accused Ramchander and Billu under Section 8/29 of NDPS Act who have also been enlarged [2025:RJ-JP:46466] (2 of 2) [CRLMB-14965/2025] on bail by the Trial Court itself on 23.01.2025 and 12.09.2024. The allegations against the present petitioner is that he is the registered owner of the vehicle involved in the matter therefore, on the ground of parity, the petitioner may be granted benefit of bail as the trial of the case may take considerable time and no further custodial interrogation is required, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner especially the fact that other co-accused Hanuman and Guddu have been granted bail by co-ordinate bench of this Court and other co-accused Ramchander and Billu have been granted by the Trial Court but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Dharmendra S/o Sh. Ram Swaroop, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
