The petitioner has filed the present contempt petition for non-compliance of order dated 09-01-2025 passed in WPS No.92/2025. 2. Learned counsel for the petitioner would submit that the petitioner had filed writ petition before this Court in which an order has been passed on 09-01- 2025 holding the petitioner entitled for two annual increments on account of her being passing B.Ed. Examination and her writ petition has been allowed in similar terms of the order dated 06-12-2013 passed in WPS No.6927/2011 and other batch of petitions in which the petitioners have clearly held entitled for two annual increment, yet the authorities have rejected the representation of the petitioner by holding that since the appointment of the petitioner is after 16th June, 1993 and as per the circular issued by the State Government dated 07-03-2020, the teachers who have appointed after 16th June, 1993 Digitally signed by MOHAMMAD AADIL KHAN 2 and acquired their B.Ed qualification on their own expenses would not be entitled for two annual increment which is the clear violation of the order dated 06-12-2013 passed in WPS No.6927/2011 and the order dated 09-01- 2025 passed in WPS No.92/2025 filed by the petitioner. 3. I have heard learned counsel for the petitioner and perused the material annexed with the petition. 4. Although the writ petition filed by the petitioner was allowed in similar terms of the order dated 06-12-2013 passed in WPS No.6927/2011 and she was held entitled for annual increment as per the order dated 06-12-2013, however, the State authority has every right to examine the case and service record of the petitioner with respect to her entitlement in accordance with the applicable rules and circulars. On the representation being made by the petitioner on 14-01-2025, her claim has been rejected holding that since the petitioner was appointed after 16th June, 1993 and as per circular dated 07- 03-2020 issued by the State Government she is not entitled for annual increment on the ground that she acquired her B.Ed qualification on her own expenses, I do not find any willful violation or deliberate omission on part of the State authorities while passing the order dated 14-05-2025. 5.
