JUSTICE MRIDUL KUMAR KALITA ORDER 21.08.2026 [1] Heard Mr. K.K. Bhatta, the learned counsel for the applicant. Also heard Mr. M. Talukdar, the learned counsel for the opposite party/claimant as well as Ms. M. Choudhury, the learned counsel for opposite party No. 3. [2] This interlocutory application has been filed by the applicant/insurance company praying for condonation of delay of 117 days in preferring the connected MAC Appeal. [3] The learned counsel for the applicant has submitted that the applicant has stated the reasons for delay in paragraph Nos. 4 and 5 of the instant application. [4] On the other hand, Mr. M. Talukdar, the learned counsel for the opposite parties/claimants submits that he does not have any objection in condoning the delay as prayed for by the applicant. [5] He submits that there is a likelihood of the parties arriving at an amicable settlement as a talk of Page No.# 3/3 compromise is going on between them. [6] Ms. M. Choudhury, also does not raise any objection. [7] I have considered the submissions made by the learned counsel for both sides. [8] After considering the grounds stated in the instant interlocutory application to be sufficient cause which prevented the applicant in approaching this court within prescribed period of limitation in filing the connected appeal as well as considering the fact that a talk of compromise is going on between the parties, the delay of 117 days in preferring the connected appeal is hereby condoned and this interlocutory application is allowed. [9] The Registry shall register the connected MAC Appeal and list the same for admission in the next week. [10] The name of Mr. M. Talukdar may be shown in the cause list for respondent No. 1. [11] The name of Ms. M. Choudhury may also be shown in the cause list as engaged counsel for the respondent No. 3 henceforth. JUDGE Comparing Assistant
