At this stage, Learned P.P. drawn the attention of this Court that in this case, the IO has laid charge-sheet against the accused before the Learned Lower Court with a prayer for custody trial of the accused. Learned Senior Counsel drawn the attention of this Court that he has not received the copy of charge-sheet, so at this stage, he intends to withdraw the bail application with a liberty to file afresh. Considered. The submission of Learned Senior Counsel is accepted and he is at liberty to withdraw the application of bail on condition to refile the same, if required, in future. 2 In view of the above, send back the case record to the concerned CJM/Jurisdictional Magistrate along with a copy of this order.
