Topno, A.P.P. ------ 03/ 22.12.2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Kandi P.S. Case No. 115 of 2025, registered for the offence under Sections 85, 115(2), 126(2), 109(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 3/4 of Dowry Prohibition Act, pending in the court of learned Judicial Magistrate, 1st Class, Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be the husband of the informant and there are general and omnibus allegation against all the accused persons. He next submits that the in-laws of the informant have already been provided the privilege of anticipatory bail by the learned Sessions Judge. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner is the husband of the informant. 5. Looking into the contents of the FIR, it transpires that there are general and omnibus allegation against all the accused persons and the entire family members have been made accused and further the [2025:JHHC:38613] -2- in-laws of the informant have already been provided the privilege of anticipatory bail by the learned Sessions Judge, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks after X-mas Holidays and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
