JUSTICE RAVI CHIRANIA Order 01/12/2025 Today, the learned Senior Counsel appearing on behalf of the appellants submits that the learned Single Judge while passing the order dated 27.09.2018 in Para No.40 quashed the entire notification (declaration) dated 04.05.2009 issued by the State Government. Learned Senior Counsel further submits that only one petitioner challenged the said notification whereas lands of multiple khatedars were also involved in the said notification. Learned Senior Counsel prayed that impugned order passed by the learned Single Judge may be modified and made confined to the land as mentioned in the para no.9 of the writ petition. Counsel appearing on behalf of the respondents has no objection to the submissions made by the learned Senior Counsel appearing on behalf of the appellants. In that view of the matter, this appeal is partly allowed and the order dated 27.09.2018 passed by the learned Single Judge in para no.40 is modified to the extent that the notification (declaration) dated 04.05.2009 is quashed qua the land mentioned in para no.9 of the writ petition.
