The petitioner has filed the present writ petition challenging the posting order dated 04.06.2025 (Annexure P/1) whereby the petitioner who is ALOK SHARMA Digitally signed by ALOK SHARMA Date: 2025.08.08 19:29:08 +0530 2 Assistant Teacher (LB) has been posted at Govt. Primary School Gattakal. 2. Learned counsel for the petitioner would submit that the respondent No. 6 was promoted and posted in the school at Gyan Jyoti Kakodi vide order dated 28.09.2022, the respondent No. 6 belongs to Assistant Teacher (E) category whereas the petitioner is Assistant Teacher (T) category and considering the respondent No. 6 posted there at Gyan Jyoti School, Kokodi, the petitioner has been declared surplus raising her grievances she made her representation on 12.06.2025 to the Respondent No. 3 and on 21.07.2025 to Respondent No. 4 but till date her representation has not been decided. 3. On the other hand, learned counsel for State opposes and have submitted that on 07.07.2024, the State Government has constituted a Committee headed by the Divisional Commissioner to examine the orders passed by the Divisional/District Level Rationalization Committee and the representation of the petitioner is pending, therefore, the petitioner may approach before the Committee and raise his grievances and then the Committee will decide her grievance in accordance with law. 4. I have heard learned counsel for the parties and perused the material annexed with the petition. 5. Considering the submissions made by learned counsel for the parties, looking to the nature of dispute raised by the petitioner and the fact that she has already made his representation on 12.06.2025 and 21.07.2025 before the respondent No. 3 & 4 respectively. The 3 petitioner is directed to make her fresh representation before the Divisional/District Level Rationalization Committee as constituted under notification dated 07.07.2025 and if such representation is being made the Divisional/District Level Committee shall take a decision on the representation of the petitioner within three weeks from the date of receipt of fresh representation of the petitioner. 6.
