1. By way of present application, the applicant/petitioner seeks release of the sum deposited by the petitioner in pursuance of the order dated
13.07.2023.

Learned counsel for the applicant/petitioner states that the writ petition had been filed assailing the impugned order dated 22.12.2017 passed by the Authority under the Delhi Shops & Establishment Act, 1954. It is further stated that the Court had passed the aforesaid directions while staying the operation of the impugned order vide order dated 13.07.2023. He submits that subsequently, vide the judgment dated 07.04.2025, noting the contents therein, the impugned order was set aside and the parties were remanded back to the Labour Court for fresh consideration.

Learned counsel for respondent No.1 fairly submits that in light of the
judgment dated 07.04.2025, she has no objection to the release of the deposited amount to the applicant/petitioner.

Considering that the deposit made by the applicant/petitioner was conditional on the impugned order being stayed and the order having been set aside vide the aforesaid judgment, and further in view of the no objection given by the other side, there is no impediment in release of the amount to the petitioner. Accordingly, the deposited amount be released to the petitioner alongwith the interest accrued thereupon.
5. In view of the above, the present application is disposed of.
