1. The petitioner has challenged his transfer order dated 15.07.2025 in the present writ petition claiming the following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to call upon the records related to the case of the petitioner from the Respondent Authorities for its kind consideration. 10.2 That this Hon'ble Court may kindly be pleased to issue writ/order/directions of appropriate nature and set aside the impugned transfer order dated 15.07.2025 passed by Respondent No. 02. (Annexure P/1). 10.3 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the case of petitioner and decide the representation dated 28.07.2025 (Annexure P/9) sympathetically on compassionate grounds, in view of the prevailing Transfer Policy. 10.4 That, the Hon'ble Court may kindly be pleased to grant any other relief which this Hon'ble Court may deem fit and appropriate.”

Learned counsel for the petitioner would submit that the petitioner vide
order dated 10.07.2024 assigned the charge of Kawardha branch of the bank and within a short span of time, he has again been transferred vide order dated 26.05.2025 from Kawardha branch to Home Loan branch, Rewa. Though he has not joined at Home Loan branch, Rewa and the respondents/Bank vide order dated 25.06.2025
3 transferred one Smt. Pramila Singh Thakur at Home Loan Centre, Rewa of the respondents/Bank. Thereafter, vide impugned transfer
order 15.07.2025, the petitioner has been transferred from Kawardha branch to ACB Bankhedi branch. He would further submit that the petitioner is having various family issues including health problem of his old aged mother, for which he made his representation on 28.07.2025 (Annexure P/9) and during pendency of the present writ petition, his representation has been decided by one-lined order and no reason has been assigned in that order. The petitioner is willing to make his detailed representation along with all the medical documents and the respondent authorities may be directed to consider the representation of the petitioner on compassionate ground as provided under clause (viii) of the transfer policy of the Bank.

On the other hand, learned counsel for the respondents/Bank though opposes on merits, however he would submit that, he has no objection, if such a direction is being given to take a decision on the detailed representation of the petitioner, if so filed by him in accordance with law under the transfer policy of the Bank.

Considering the submissions made by learned counsel for the parties, considering the issue involved in the present writ petition, the petitioner is directed to move his fresh detailed representation supported by the documents to the authorities concerned within 03 days from today, and if such a representation is being made, the authorities concerned shall take a decision on the representation of the petitioner within the further period of 10 days from the date of its receipt, in accordance with law
4 and as per the applicable rules and circulars of the bank, particularly keeping in view the clause (viii) of the transfer policy, which prescribes the transfer on compassionate ground.
5. With the aforesaid observations, the present writ petition is disposed of. Sd/- (Ravindra Kumar Agrawal) Judge ved
