Petitioners are aggrieved by the order by which the Plaintiffs have been permitted to bring on record certain documents at the final stage or argument. After initial argument, learned counsel for the petitioners submits that the interest of the defendant(s) will be seriously prejudiced as they will not get any opportunity to rebut the evidence which has been brought at the stage of argument and seeks permission to withdraw the instant CMP if opportunity to rebut the evidence is allowed. Accordingly, the instant CMP is dismissed as withdrawn with aforesaid liberty to lead evidence to rebut the documentary evidence which has been led on behalf of the plaintiff(s) at the stage of argument.
