THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, THE COURT MADE THE FOLLOWING: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ) 1. The petitioner is before this Court seeking for the following reliefs: a. Issue a writ in the nature of certiorari quashing the compromise decree dated 30.12.2021 passed in O.S. No.121/2021 on the file of the Court of Principal Civil Judge, Raibag vide Annexure-C, consequently remand the suit for afresh consideration. b. Pass such other orders as this Hon’ble Court may deem fit, proper, and necessary in the interest of justice and equity. 2. What has been challenged is the compromise which has been entered into before the Lok Adalat in O.S. No.121/2021. The submission of learned counsel for the petitioner is that the petitioner has not signed the compromise and the same is a fraudulent document. - 3 - HC-KAR NC: 2025:KHC-D:12957 WP No. 107087 of 2025 3. A perusal of the order sheet which has been produced indicates that it is the counsel for the petitioner/plaintiff No.1, who had filed an I.A. along with a memo for advancing the matter and refering to Lok Adalath. In pursuance there too, the signature of the petitioner has been obtained in the order sheet, as also in the compromise petition. The petitioner has been identified by his counsel before the Lok Adalath. Such being the case, when the petitioner's photograph is found on the compromise petition and he being identified by his counsel, no particular action having been taken against the counsel for allegedly identifying a wrong person and or being part of the impersonation.
