Mr. Deepak Joshi, learned counsel for the petitioner/accused. 2. Present petition is filed under 528 B.N.S.S.to quash the summoning order dated 21.08.2018 passed by learned Judicial Magistrate-I, Rudrapur, District Udham Singh Nagar in Complaint Case No. 7475 of 2018 under Section 138 of the Negotiable Instruments Act. 3. Learned counsel for the petitioner/accused would submit that there is a dispute related to money transaction between the petitioner/accused and the respondent; that, now the petitioner/accused is ready and willing to pay the entire alleged cheque amount to the respondent/complainant, therefore, liberty be granted to the petitioner/accused to make an offer along with bail application before the trial court and till then the proceedings of the criminal case may be stayed. 4. In view of the above, without expressing any opinion on the final merits of the case, the petition is disposed of with liberty to the petitioner/accused to file bail application before the trial court within 15 days from today and the concerned trial court shall decide the same expeditiously in accordance with law. 5. Till decision on the bail application, further proceedings of the Complaint Case No. 7475 of 2018 under Section 138 of the Negotiable Instruments Act pending in the 2025:UHC:1855 court of learned Judicial Magistrate-I, Rudrapur, District Udham Singh Nagar shall remain stayed. If the accused does not approach the trial court for moving the bail application within stipulated time then the trial court would be at liberty to proceed with the matter as per law.
