HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 700/2024 Anita Kumari W/o Shri Suresh Kumar, Aged About 35 Years, R/o Hanotiya Mawatiyan, P.s Kaamkheda, District Jhalawar (Raj.). (At Present Confined In Central Jail Jhalawar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Samarath Sharma For Respondent(s) : Mr. N.S. Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 02/01/2025
1. Petitioner has filed this miscellaneous bail application under Section 438 Cr.P.C.
2. F.I.R. No. 21/2022 was registered at Police Station Kaamkheda, District Jhalawar (Raj.) for offences under Sections 420, 467, 468 & 471 of IPC.
3. It is contended by counsel for the petitioner that the accused-petitioner has been falsely implicated in this case. Counsel for the petitioner submits that petitioner was Sarpanch at the relevant time and her signatures were forged by someone as she did not fill in muster rolls. Counsel further submits that petitioner is a lady and she is ready to join and cooperate in the investigation. Counsel further submits that she herself submitted an application to verify her signature on muster roll. Custodial
(2 of 2) [CRLMB-700/2024] interrogation of the petitioner is not required in this matter. The amount which has been said to be misappropriated in this matter is petty amount. He thus, prays that instant bail application under Section 438 Cr.PC may kindly be allowed.
4. Learned State counsel opposes the submission made by the counsel for the petitioner. He has placed on record copy of the factual report dated 09.07.2024 as per which certain amount was to be transferred in the bank accounts of Late Shokat Ali and Late Rati Bai but the accused persons hatched a conspiracy and in a very planned manner, the said amount was transferred in the account of some other persons. He argues that without connivance of the petitioner, it cannot be done.
5. I have considered the contentions.
6. Having regard to the totality of the facts and circumstances of the case and looking to the nature of allegation that public exchequer/money of a Welfare Scheme has been allegedly misappropriated by the petitioner, without commenting anything on the merits/demerits of the case, I am not inclined to accept this anticipatory bail application. Accordingly, the anticipatory bail application is dismissed.
