(At Present Confined In Sub Jail, Bayana, District Bharatpur). ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Timan Singh For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 01/12/2025 1. Learned counsel for the petitioner-Chetram @ Banti wants to withdraw this bail application with liberty to file fresh after recording the statement of the victim. 2. Hence, the bail application of the petitioner-Chetram @ Banti is dismissed as withdrawn with liberty as prayed. 3. The petitioner-Aidal has preferred this bail application under Section 483 of BNSS in FIR No.316/2025 registered at Police Station Rudawal, District-Bharatpur for offences under Sections 305(a) and 331(6) of BNS. 4. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. [2025:RJ-JP:48609] (2 of 2) [CRLMB-14235/2025] 5. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The allegation against the accused-petitioner-Aidal is for committing the theft. No recovery has been effected against him and FIR has been lodged against the accused-petitioner-Aidal on false and concocted grounds. Though there is one case reported against the petitioner-Aidal but in the said case he has been bailed out. Petitioner is behind the bars since 24.09.2025. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence, the bail application of the petitioner may be allowed. 6. Learned Public Prosecutor has vehemently opposed the bail application. 7. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 8. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Aidal S/o Daulatiya shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
