Rakesh Kainthla, Judge (Oral) It has been submitted on behalf of the State that the State has no objection for releasing the articles seized in the personal search, except the passport and the amount which as per the State was withdrawn from the account of the deceased, which is the subject matter of the case.
2. Learned counsel for the petitioner does not press the withdrawal regarding the money and the passport.
3. In view of this, the present petition is allowed and the articles seized during the personal search of the petitioner, except 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes.
2 ₹2,86,000/- and passport of the petitioner, be released to the petitioner on his furnishing sapurdari bond in the sum of ₹50,000/-, undertaking therein to produce the articles as and when called upon to do so and in case of default, to pay a sum of ₹50,000/- to the State of H.P.
4. The petitioner shall not change the nature of the articles, so released to him. The photocopies of the documents released to the petitioner be prepared at his expenses. Hence, all the articles. except ₹2,86,000/- and passport are ordered to be released to the petitioner after retaining their photographs against proper receipt and identification.
5. The petition stands disposed of so also the pending miscellaneous application(s), if any. (Rakesh Kainthla) Judge
