HON'BLE MR. JUSTICE ANIL KUMAR UPMAN
Order 11/07/2025 The instant writ petition has been filed with the following prayers:
“i. By an appropriate writ, order or direction the order dated 13.02.2025 and 27.05.2025 issued by the Additional Commissioner, Food and Civil Supply as well as notice inviting bid dated 13.06.2025 may kindly be quashed and set aside.
[2025:RJ-JP:25763] (2 of 2) [CW-10001/2025] ii. Any other relief, which this Hon’ble Court may deem fit, just and proper in the circumstances of the case, the same may kindly be granted in favour of the petitioner.” Admittedly, an appeal under Section 38 of the Rajasthan Transparency in Public Procurement Act, 2012 (for short, ‘the Act of 2012’) against notice dated 13.06.2025 inviting bid has been filed and same is pending before the appellate authority alongwith stay application. In view of the fact that appeal is pending before the appellate authority, this Court is not inclined to entertain the writ petition, the same is dismissed. However, appellate authority is
directed to expedite the hearing of the appeal as provided Sub- Section 6 of Section 38 of the Act of 2012. Needless to say that if any stay application is filed by the petitioner alongwith appeal, same shall be considered and decided expeditiously without unnecessary delay. Accordingly, this writ petition as well as stay application is dismissed.
