To set aside the impugned letter dated 02.07.2022. ii. To kindly direct the respondent to disburse the leftover/ remaining arrears from September, 2008 to February, 2009, along Digitally signed by AJINKYA PANSARE Date: 2025.09.02 14:05:56 +0530 2 with the interest, from the initial date of disbursement. iii. To kindly make any other order or writ that may be deemed fit and just in the facts and circumstances of the case. 2) Learned counsel appearing on behalf of respective respondents submit that respondent No. 2 – Bank in para – 2 of its reply has categorically stated that writ petition was filed on 14.10.2022 whereas arrears pertaining to period between September, 2008 till February, 2009 amounting to Rs. 15,734/- was deposited in the Bank A/c of the petitioner on 15.07.2010 and petitioner has filed this petition suppressing this fact. 3) Heard. 4) From perusal of voucher issued by Accountant of respondent – Bank (Annexure R-2/1), it appears that amount of Rs. 15,734/- has been disbursed by the Accountant of respondent – Bank and same has been deposited into the Bank A/c of the petitioner on 15.07.2010 itself. 5) Taking into consideration the above-discussed facts, in the opinion of this Court, nothing survives for adjudication. Consequently, this petition stands dismissed. However, petitioner would be at liberty to revive if cause of action subsists. Sd/- (Rakesh Mohan Pandey) JUDGE A j i n k y a
