Heard the parties. The petitioner has moved this Court for grant of bail in connection with Garu P.S. Case No.27 of 2018 (G.R. No. 228A of 2019) registered for the offences punishable under sections 147/148/149/323/386/387/427/435 of the Indian Penal Code and under Section 17 of the C.L.A. Act. The learned counsel for the petitioner submits that this is the second journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail was rejected vide order dated 30.04.2025 in B.A. No. 3438 of 2025 and the fresh ground is that the co-accused-Gorakh Ji @ Amriteshwar Singh who faced the trial in the main file and in whose confession the petitioner has been implicated in this case has been acquitted vide judgment dated 03.11.2025 consequent upon P.Ws. 1 to 5 and 9 to 11 not supporting the case of the prosecution and declared hostile and P.Ws. 6 to 8 and 13 have stated that they could not identify any of the accused person as they had covered their faces, P.W.12 is a post occurrence witness and has no knowledge about the occurrence, P.W.14 is the A.S.I of the police and P.W.15 is the I.O. of the case. It is further submitted that the allegations against the petitioner are all false. It is then submitted that the petitioner has been in custody since 05.12.2024, as has been mentioned in paragraph no. 01 of the bail application and charge has not yet been framed against him. It
is then submitted that he was not put on T.I.P. and the petitioner is not named in the FIR. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Latehar, in connection with Garu P.S. Case No.27 of 2018 (G.R. No. 228A of 2019) with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case.
