Through Its Director Sanjay Kumar Yadav S/o Shri B, Resident Of Village And Post Office Kosali, Rewari, Haryana ----Petitioner Versus Rajasthan University Of Health Sciences Through Its Registrar, Sector-18, Kumbha Marg, Pratap Nagar, Tonk Road, Jaipur ----Respondent For Petitioner(s) : Mr. Vijay Pathak Mr. Ganesh Dutt Gautam Mr. Mohd. Kasim Khan & Mr. Arbaz Khan for Mr. Tanveer Ahamed. For Respondent(s) : Mr. Samit Bishnoi JUSTICE ANOOP KUMAR DHAND Order 17/09/2025 (2 of 3) [CW-14576/2016] 1. Since common questions of law and facts are involved in these writ petitions, hence, with the consent of counsel for the parties, both these matters are taken up together for final disposal and the same are being decided by this common order. 2. By way of filing these writ petitions, a prayer has been sought for issuing directions to the respondents to revise/modify the provisional list of colleges (B.Sc. Nursing) for counselling for the academic sessions 2015-16 & 2016-17 and for including the name of the petitioner-institutions in the counselling process for admission in B.Sc. Nursing. 3. Learned counsel for the petitioner-institutions submits that pursuant to the interim orders passed by this Court, the students were allotted the petitioner-institutions and they have appeared in the B.Sc. Nursing examination, but the respondent-University has not issued the mark-sheet/degrees to them, inspite of completion of their B.Sc. Nursing Course. Learned counsel submits that during pendency of these writ petitions, the admitted students have already completed the aforesaid course and the needful exercise has already been done in favour of the petitioner-institutions, so appropriate directions be issued to the respondent-University to declare the result of the students, who had studied in the petitioner-institutions and issue mark-sheets and award degrees to the students. 4. Per contra, learned counsel appearing on behalf of the respondent-University opposes the arguments raised by learned counsel for the petitioner-institutions, but he is not in a position to controvert the arguments made by learned counsel for the petitioner-institutions. (3 of 3) [CW-14576/2016] 5. After considering the arguments put forward by learned counsel for the petitioner-institutions, it is to be noted that pursuant to the interim orders passed by this Court, the petitioner-institutions were permitted to participate in the counselling process and the students were granted admission to the petitioner-institutions and they were permitted to appear in the examination also. The students have already completed their B.Sc. Nursing Course and, thereafter, provisional certificates have also been issued in their favour. 6. In view of above, this Court deems it just and proper to dispose of these writ petitions by issuing directions to the respondents to issue mark-sheets to the students of the petitioner-institutions and award them degrees in accordance with law. 7. Stay applications as well as all applications (pending, if any) also stand disposed of. (ANOOP KUMAR DHAND),J Karan/66-67
