This is plaintiffs' petition. 2. It is contended by learned counsel for the petitioner that Suit No. 2006 of 1995 filed by plaintiffs was dismissed for want of prosecution on 02.03.2012 and an application for recalling the said order was filed under Order IX Rule 9 CPC which has been registered as Restoration Application No. 7/74 of 2012, which is pending consideration. The sole prayer made is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon court concerned to decide the Restoration Application No. 7/74 of 2012 pending in Suit No. 2006 of 1995, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
