( 2025:JHHC:37559 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 10855 of 2025 ------ Suraj Kumar Paswan @ Suraj Paswan, aged about 31 years, S/o –Late Sambhu Paswan, resident of House No. 188, Banta Nagar, Near S.N. High School, Adityapur, P.O. Adityapur, P.S. –R.I.T., District –Seraikella –Kharsawan, Jharkhand. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Pran Pranay, Advocate For the State : Mrs. Lily Sahay, Addl. P.P. ------ Order No.03 Dated- 12.12.2025 Heard the parties. The petitioner has moved this Court for grant of bail in connection with R.I.T. P.S. Case No.63 of 2023 corresponding to S.T. Case No. 186 of 2024 registered for the offences punishable under sections 341, 323, 376, 420, 406, 506 of the Indian Penal Code. The learned counsel for the petitioner submits that this is the third journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail of the petitioner was rejected vide order dated 25.09.2024 in B.A. No. 7264 of 2024 and vide order dated 01.05.2025 in B.A. No. 3416 of 2025. It is further submitted by the learned counsel for the petitioner that the only fresh ground is that so far three witnesses have been examined during the trial of the case including the victim and they have supported the case of the prosecution but the victim has departed from her re-statement before the police. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that the keeping in view the serious nature of allegation against the petitioner and in view of the overwhelming evidence that has come against him during the trial, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail. Considering the serious nature of allegation against the petitioner and the chances of the petitioner absconding as also tampering with evidence, if released on bail, this Court is not inclined to admit the petitioner on bail. Accordingly, the prayer for regular bail of the above-named petitioner is rejected. (Anil Kumar Choudhary, J.) 12.12.2025 Sonu/Gunjan-
