Petitioner herein, who at present is working as Patwari at SNT Circle Jayhar, District Sirmaur, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation (Annexure P-4), whereby he has prayed for his transfer from Settlement Department to Revenue Department on secondment basis on medical grounds.

It is averred in the petition, which is duly supported by an affidavit that petitioner, who at present is working in the settlement department is finding it difficult to do the field work on account of illness. Since doctor has advised him to remain stationed near his native place, he has approached the respondents by way of
- 2 - representation praying therein for his transfer from Settlement Department to Revenue Department on secondmnet basis.

Having regard to the nature of order proposed to be passed in the instant proceedings, this Court sees no necessity to call for reply from the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. Mr. Kahol fairly states that representation, if not already decided, shall be considered expeditiously in accordance with law.

Having taken note of the averments contained in the petition as well as documents adduced on record suggestive of the fact that petitioner is not in fit state of health and has been advised posting near his native place, this court without going into the merits of the case, deems it fit to dispose of the same with direction to the respondents to consider and decide the representation of the petitioner, expeditiously, preferably, within four weeks. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass a speaking order taking note of rules occupying the field. Pending applications, if any, also stand disposed of. December 3, 2025
