IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.5947 of 2025 Rabindra Sahu … Petitioner Mr. A.K. Sahoo, Advocate -versus- State of Odisha and another … Opposite Parties Mr. M.R. Patra, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 08.09.2025 04. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Kundheigola PS Case No. 107 of 2018 corresponding to Spl. GR Case No.20 of 2018 pending in the Court of learned Addl. District & Sessions Judge-cum-Special Judge, Deogarh for commission of offences punishable U/Ss. 376(AB)/376(3)/376(2)(f)(n)/506 of IPC r/w Section 6 of POCSO Act, on the main allegation of committing rape and aggravated penetrative sexual assault upon five victims aged about less than 16 years. 3. Heard, Mr. Akshaya Kumar Sahoo, learned counsel for the Petitioner and Mr. M.R. Patra, learned Addl. Public Prosecutor in the matter and perused the record. None appears for the victims despite being duly informed as apprised by learned Addl. PP. 4. Bail is sought for to the accused-petitioner mainly on the ground of delay in disposal of the case, but the allegation appearing against the Petitioner is not only serious, but also heinous and it is alleged that the Petitioner being a tuition teacher had sexually exploited some minor girls. Right now, trial has already progressed and 15 witnesses have already been examined. In such view of the matter and after having considered the rival submissions and on going through the materials placed on record together with the evidence of the victim, this Court is not inclined to grant bail to the Petitioner. Hence, the bail application of the petitioner stands rejected. However, the Petitioner may renew his prayer for bail, if the trial is not concluded within six months hence which extent of time has been sought for by the learned trial Court to conclude the same. 5. Accordingly, the BLAPL stands disposed of. 6. Issue urgent certified copy of the order as per Rules. (G. Satapathy) Judge Priyajit
