NO.62 OF 2016) THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI AND THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM APPEAL SUIT NO: 62 OF 2016 JUDGMENT:- (per Hon’ble Sri Justice Maheswara Rao Kuncheam) This appeal has been filed by the appellant/defendant No.1, challenging the decree dated 05.11.2015 passed in O.S.No.59 of 2009 on the file of VII Additional District Judge (Fast Track Court), Visakhapatnam, filed by the 1st respondent/plaintiff for cancellation of sale deed dated 08.12.2008 and for permanent injunction, which was decreed on merits. 2. This Court has not granted any interim order in this appeal. 3. Smt. G. Jyothi, learned counsel representing Sri G. Rama Gopal, learned counsel for the 1st respondent, submits that she filed a memo informing that the 1st respondent/plaintiff, Nallamilli Veera Venkata Someswara Prasad Reddy, expired on 26.12.2023. She has annexed the death certificate of the 1st respondent to that effect. She further informed that the said memo was served on the appellant’s counsel way back on 23.02.2024. However, no steps have been taken by the learned counsel for the appellant. 4. As the matter pertains to the year 2016, it is listed in the “Weekly Cause-list”. 5. Today, when the matter is called, there is no representation for the appellant. Even, at the revised call also, none appeared on the (RNT,J & MRK,J A.S. NO.62 OF 2016) appellant’s side to take steps, which indicates that the appellant has no interest to proceed further in the matter. 6. In view of the above, the Appeal Suit is dismissed for default. No order as to costs.
