1. Heard. 2. The appellant has filed the instant appeal under Section 374(2) of the Code of Criminal Procedure, 1973, (hence forth ‘the Cr.P.C.’) questioning the judgment of conviction and order of sentence dated 12.09.2018 passed by the learned Additional Sessions Judge (FTC), District- Rajnandgaon, Chhattisgarh in Special Criminal Case No. 45/2016, whereby the apellant has been convicted and sentenced as under:- Conviction Sentence Section 363 of Indian Penal Code 5 Years R.I. and fine of Rs. 2000 to accused /appellant and in default of payment of fine amount further 3 month S.I. Section 366 of Indian Penal Code 5 Years R.I. and fine of Rs. 2000 to accused/appellant and in default of payment of fine amount further 3 month S.I. Section 323 of Indian Penal Code 6 months S.1. fine of Rs. 100 to accused /appellant and in default of payment of fine amount further to 7 days of S.I. Section 506(2) of Indian Penal Code 1 Year R.I. and fine of Rs. 500 to accused /appellant and in
3 default of payment of fine amount further 1 month S.I. Section 4 of POCSO Act, 2012 10 Years R.I. and fine of Rs. 5000 to accused / appellant and in default of payment of fine amount further to 6 months of S.I. Section 3/181 of M.V. Act, 1988 fine of Rs. 100 to accused /appellant and in default of payment of fine amount to 7 days of S.I. All the sentences were directed to run concurrently. 3.
A memorandum has been issued by learned Additional Sessions Judge (FTC) stating that appellant herein has died on 09.03.2025, which is supported by a death certificate issued by the Registrar Birth and Death, Municipal Corporation Rajnandgoan. 4.
