Learned counsel for the petitioner would submit that the petitioner is the owner of the motor cycle bearing Registration No. AP 16 BY 9424 and as per contents of the complaint, the 2nd respondent herein is neither the eye witness nor present at the alleged scene of offence. In fact the vehicle belonging to the petitioner was no involved in the alleged accident and for no fault of him, he has been roped into the false case. Hence, the petition may be disposed of without causing any prejudice to the rights and contentions of the petitioner, by dispensing the presence of the petitioner before the Trial Court. 4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 5. In that view, the Criminal petition is disposed of. However, the petitioner is at liberty to raise all the contentions before the Trial Court in their defence. The presence of the petitioner before the Trial Court is dispensed with unless his presence is specifically directed by the Trial Court. Stay granted by this Court shall stands vacated.
