1. Heard Mr. Anshul Tiwari, learned counsel for the petitioner. Also heard Mr. Vivek Sharma, learned Additional Advocate General, appearing for the State, Mr. Mayank Chandrakar, learned counsel, appearing for respondent No. 8 and Dr. Saurabh Kumar Pande, learned counsel, appearing for respondent No. 13.
2. The present writ petition styled as ‘Public Interest Litigation’ has been filed by the petitioner with the following prayers:

“10.1 That, the Hon’ble Court may kindly be pleased to issue writ/writs, direction/directions, directing a thorough, independent CBI investigation into the manner in which the public servants and stakeholders knowingly sanctioned and disbursed the excess compensation. 10.2 That, the Hon’ble Court may kindly be pleased to issue writ/writs, direction/directions, directing a registration of a First Information Report under the relevant provisions of the Indian Penal Code and Prevention of Corruption Act against all officers, employees, and villagers implicated in the misappropriation of public funds, and to ensure prompt and impartial criminal investigation and prosecution, so as to curb this serious malice and safeguard the public exchequer. 10.3 That, the Hon’ble Court may kindly be pleased to issue writ/writs, direction/directions, directing an immediate attachment and seizure of bank accounts, movable and immovable property of all recipients of the excess Rs. 300 crore compensation awarded in village Bajarmuda and further be directed to recover the excess compensation amount from all the awardees.”

Learned counsel for the petitioner submits that the petitioner is a practicing Advocate by profession and is a pro bono publico member of the Society, genuinely concerned with the interest of the general public. It is submitted that the petitioner is actively engaged in work for the betterment of society and, therefore, has no personal interest in the matter. He further submits that the petition has been filed at his own
21 cost and expenses and not at the instance of any other person. It is also stated that no other petition of the same nature or involving the same issue has either been filed before this Court or is pending consideration.

It is further contended by learned counsel for the petitioner that the present Public Interest Litigation is filed in the larger interest of justice and equity to challenge the arbitrary and illegal award of compensation relating to acquisition of surface rights over 170.416 hectares of land in Village Bajarmuda, Tehsil Gharghoda, District Raigarh. The petitioner also challenges the inaction of the respondent authorities in failing to take coercive action against the officers involved, despite sufficient knowledge, proof, and reports highlighting misappropriation of Government funds. It is contended that the impugned awards have resulted in payment of highly inflated compensation, in connivance with senior revenue officials, thereby causing huge financial loss to the Government exchequer and, consequently, to the public at large.

Learned counsel for the petitioner further submits that despite several complaints made by the petitioner to the Directorate of Enforcement, the Revenue Board, and other authorities, and despite constitution of multiple inquiry committees, no criminal proceedings have been initiated. Even though inquiry reports dated 17.03.2023 and 31.05.2024 confirmed deliberate misconduct and financial irregularities, only limited departmental action was taken against seven officers, and eventually, only three were proceeded against. This, according to the
22 petitioner, reflects a clear “pick and choose” strategy to shield equally complicit officials. It is further argued that considering the magnitude of the fraud, a CBI investigation is necessary to probe the role of the Collector, SDM, Tehsildar, MD of CSPGCL, and other officials who permitted overpayment of nearly Rs. 2300/- crores. The petitioner prays for issuance of directions to register FIRs against all officers, employees, and villagers involved in such economic crimes. Hence, this petition. 6. On the other hand, learned State counsel and learned counsel appearing for respondent Nos. 8 and 13 oppose the petition on the ground of maintainability, contending that the present petition is not a genuine Public Interest Litigation, but one filed in furtherance of the petitioner’s personal and professional interests. 7. Having heard learned counsel for the parties and perused the pleadings, this Court finds that the petitioner is a practicing lawyer who has been personally pursuing the matter before various forums and authorities. His active and direct involvement in the subject dispute demonstrates a personal stake in the outcome. Such circumstances dis- entitle him from invoking this Court’s extraordinary jurisdiction under the guise of a Public Interest Litigation. 8. The Courts should, prima facie, verify the credentials of the petitioner before entertaining a PIL. It is also well settled that the Courts before entertaining the PIL should ensure that the PIL is aimed at redressal of genuine public harm or public injury. The Court should also
23 ensure that there is no personal gain, private motive or oblique motive behind filing the public interest litigation. The Courts should ensure the jurisdiction in public interest is invoked for genuine purposes by persons who have bona fide credentials and who do not seek to espouse or pursue any extraneous object. Otherwise, the jurisdiction in public interest can become a source of misuse by private persons seeking to pursue their own vested interests. 9.
A Division Bench of the Allahabad High Court, in the case of Gurmet Singh Soni Vs. State of U.P. and others : 2021 (5) ADJ 409, noticing the decision of the Hon’ble Apex Court in State of Uttaranchal Vs. Balwant Singh Chaufal & Ors., 2010 AIR SCW 1029 and other judgments of the Hon’ble Apex Court on the issue, has dismissed the public interest litigation. 10. The Courts cannot allow its process to be abused for oblique purposes, as was observed by the Hon’ble Supreme Court Court in Ashok Kumar Pandey Vs. State of West Bengal, reported in (2004) 3 SCC 349. In Balwant Singh Chaufal (supra) the Hon’ble Supreme Court had discussed the three stages of a PIL which has been discussed above. The Hon’ble Supreme Court, in Balwant Singh Chaufal (supra) states as to how this important jurisdiction, i.e., PIL has been abused at Para 143 by observing as under:
“143. Unfortunately, of late, it has been noticed that such an important jurisdiction which has been carefully carved out, created and nurtured with great care and caution by the courts, is being blatantly abused by filing some petitions with oblique motives. We think time has come when genuine and bona fide
24 public interest litigation must be encouraged whereas frivolous public interest litigation should be discouraged. In our considered opinion, we have to protect and preserve this important jurisdiction in the larger interest of the people of this country but we must take effective steps to prevent and cure its abuse on the basis of monetary and non-monetary directions by the courts.”
11. The Hon’ble Supreme Court, in Holicow Pictures (P) Ltd. Vs. Prem Chand Mishra, reported in (2007) 14 SCC 281 which has relied Janata Dal Vs. H.S. Chowdhary, reported in (1992) 4 SCC 305, observed as under:
“12.
It is depressing to note that on account of such trumpery proceedings initiated before the courts, innumerable days are wasted, which time otherwise could have been spent for the disposal of cases of the genuine litigants. Though we spare no efforts in fostering and developing the laudable concept of PIL and extending our long arm of sympathy to the poor, the ignorant, the oppressed and the needy whose fundamental rights are infringed and violated and whose grievances go unnoticed, unrepresented and unheard; yet we cannot avoid but express our opinion that while genuine litigants with legitimate grievances relating to civil matters involving properties worth hundreds of millions of rupees and criminal cases in which persons sentenced to death facing gallows under untold agony and persons sentenced to life imprisonment and kept in incarceration for long years, persons suffering from undue delay in service matters —government or private, persons awaiting the disposal of cases wherein huge amounts of public revenue or unauthorised collection of tax amounts are locked up, detenu expecting their release from the detention orders, etc. etc. are all standing in a long serpentine queue for years with the fond hope of getting into the courts and having their grievances redressed, the busybodies, meddlesome interlopers, wayfarers or officious interveners having absolutely no public interest except for personal gain or private profit either of themselves or as a proxy of others or for any other extraneous motivation or for glare of publicity, break the queue muffing their faces by wearing the
25 mask of public interest litigation and get into the courts by filing vexatious and frivolous petitions and thus criminally waste the valuable time of the courts and as a result of which the queue standing outside the doors of the courts never moves, which piquant situation creates frustration in the minds of the genuine litigants and resultantly they lose faith in the administration of our judicial system.”
12. The Hon’ble Supreme Court, in Gurpal Singh Vs. State of Punjab & Others, reported in (2005) 5 SCC 136, the appointment of the appellant as Auction Recorder was challenged.
The Court held that the scope of entertaining a petition styled as a public interest litigation and locus standi of the petitioner particularly in matters involving service of an employee has been examined by this Court in various cases. The Court observed that before entertaining the petition, the Court must be satisfied about (a) the credentials of the applicant; (b) the prima facie correctness or nature of information given by him; (c) the information being not vague and indefinite. The information should show gravity and seriousness involved. The Court has to strike balance between two conflicting interests; (i) nobody should be allowed to indulge in wild and reckless allegations besmirching the character of others; and (ii) avoidance of public mischief and to avoid mischievous petitions seeking to assail, for oblique motives, justifiable executive actions. 13. In the present case, the issues raised by the petitioner pertain to land acquisition compensation and alleged corruption therein, which are matters concerning affected landowners and competent authorities. The petitioner has not demonstrated any direct infringement of rights of the public at large, nor has he established credentials free from personal
26 interest. 14. In view of the above, we are satisfied that the present petition is not a genuine Public Interest Litigation, but rather an attempt to espouse a personal cause under the garb of public interest. 15. Accordingly, the writ petition stands dismissed. However, liberty is reserved to the genuinely affected parties to avail such remedies as may be available to them under law. The petitioner is also at liberty to pursue his remedy before the appropriate forum, if so advised. 16. The security amount deposited by the petitioner shall stand forfeited.
