Saini Mr. Sanjay Yadav For Respondent(s) For Complainant(s) : : Mr. Naresh Kumar Gupta, PP Mr. Azad Ahmed HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 12/11/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.360/2020 registered at Police Station Jurhara, District Bharatpur for the offence under Sections 147, 148, 149, 323, 341, 302, 307 of IPC and Section 3/25 of Arms Act, 1959 (Amendment, 2019). 2. Heard learned counsel for the petitioner, learned Public Prosecutor and counsel for the complainant and perused the material available on record. 3. The prosecution case in brief is that the act initiated by the petitioner’s side resulted in the death of Samaydeen and Asarfi in the present case. The present petitioner alleged to have actively participated in the commission of the offence by using the fire- arm. 4. Learned counsel for the petitioner submits that the petitioner [2025:RJ-JP:45539] (2 of 2) [CRLMB-12564/2025] is innocent and has falsely been implicated in this case. There is cross-case of the same incident lodged on behalf of the petitioner. He further submits that no specific overt act has been attributed to the petitioner. It is further submitted that investigation is complete and charge-sheet has been filed. The petitioner is behind the bars since 15.04.2025 and continued detention is not required, therefore, the petitioner may be released on bail. 5. On the contrary, learned Public Public Prosecutor and counsel for the complainant have vehemently opposed the bail application. They have submitted that allegations against the petitioner are grave and serious in nature. The witnesses are yet to be examined, therefore, release of the petitioner at this stage would influence the prosecution witnesses. In view thereof, the bail application of the petitioner is liable to be rejected. 6. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case especially the fact that allegations against the present petitioner are of grave and serious in nature, involving the intentional taking of two human lives but without expressing any opinion on the merits/demerits of the case, this Court is not inclined to grant benefit of bail to the petitioner. 7. Accordingly, the bail application under Section 483 B.N.S.S. is dismissed. (PRAMIL KUMAR MATHUR),J bmg/99
