NHAI Vs. Pyare Lal & Ors. OMP(M) No.255 of 2024 18.12.2025 Present: Ms. Sneh Bhimta, Advocate, for the applicant/ appellant. Mr. Yuyutsu Singh Thakur, Advocate, for respondents No.2(i) to 2(iii). OMP(M) Nos.359 & 360 of 2025 These applications have been moved for bringing on record the legal representatives of deceased respondent No.1, who died on 14.10.2023 alongwith prayer for condoning the delay in moving the application for bringing on record the legal representatives. Notice of these applications was issued to the proposed legal representatives. All proposed legal representatives of deceased respondent No.1 stand served, however, there is no appearance on their behalf. Hence, they are proceeded against ex-parte. Heard. For the cogent reasons explained in the application, delay in moving the application to bring on record the legal representatives of respondent No.1 is condoned. Accordingly, OMP(M) No.360 of 2025 is allowed. For the same reason, OMP(M) No.359 of 2025 is also allowed. Consequently, the legal representatives of respondent No.1, detailed in para 3 of the application, are ordered to be brought on record as respondents No.1(i) to 1(iv). Amended memo of parties be filed within two weeks. Registry is directed to carry out necessary corrections in the cause title. The applications stand disposed of. OMP(M) No.255 of 2024 Despite grant of several opportunities, the non- applicants/respondents have not filed reply. Learned counsel appearing for the non-applicants/respondents No.2(i) to 2(iii) states that delay in instituting the appeal be condoned as the respondents do not intend to oppose the application. I have heard learned counsel for the parties and considered the application, which is duly supported by an affidavit. The applicant/appellant has cogently explained the delay in institution of the appeal. The application is not even opposed by the non-applicants/respondents. Accordingly, for the reasons stated in the application and the submissions made by learned counsel for the parties, delay in filing the appeal is condoned. The application to stand disposed of. Arb. Appeal No. of 2025 Be registered. List for consideration after four weeks. OMP No. of 2025 (OMPST No.38858/2024) Be registered. Heard. Subject to deposit of entire awarded amount alongwith up to date interest in the Registry of this Court within four weeks, operation and execution of the impugned judgment dated 20.01.2024, passed by the learned District Judge Bilaspur, H.P. in Arbitration Case No.83 of 2019 (National Highways Authority of India Versus Pyare Lal and another), shall remain stayed.
