[2025:JHHC:30657] IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr.M.P. No.2484 of 2025 ------ Kiran Lakra @ Kiran Devi Aged about 43 years wife of- Ramesh Kumar Ram Residence of Vill.- Heshmi, P.O.- Sosai & P.S- Mandar, Dist.- Ranchi. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Abhay Kr. Chaturvedy, Advocate For the State : Mr. Pankaj Kumar Mishra, Addl.P.P. ------ Order No:-03 Dated:-26-09-2025 Heard the parties. This Criminal Miscellaneous Petition has been filed by the petitioner with a prayer for restoration of Cr.M.P. No.462 of 2025 to its original file which stood dismissed for non-compliance of the peremptory order dated 28.03.2025. Learned counsel for the petitioner submits that Cr.M.P. No.462 of 2025 stood dismissed for non-compliance of the peremptory order dated 28.03.2025. It is next submitted that the petitioner was directed to file a supplementary affidavit annexing therewith the copy of the demand draft of Rs.1,35,000/- drawn in favour of the informant in terms of the order dated 30.01.2025 passed in A.B.A. No.5696 of 2024 but due to paucity of money, the petitioner could not deposit the same and also could not furnish the proof of the said deposit within the stipulated time; which resulted in dismissal of the said Cr.M.P. No.462 of 2025 for non-compliance of the peremptory order dated 28.03.2025. It is then submitted that now the petitioner has deposited the said amount the copy of which has been kept at brief. It is further submitted that non-compliance of the peremptory order dated 28.03.2025 was neither deliberate nor intentional. It is also submitted that the petitioner has very good grounds to agitate in the said Cr.M.P. No.462 of 2025 and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the Cr.M.P. No.462 of 2025 be restored to its original file. Learned Addl.P.P. appearing for the State has not raised any serious objection. Considering the aforesaid submission of the learned counsel for the petitioner, Cr.M.P. No.462 of 2025 is directed to be restored to its original file at the same stage at which it was before its dismissal. Registry is directed to list Cr.M.P. No.462 of 2025 before the appropriate Bench after a week. This Criminal Miscellaneous Petition is disposed of accordingly. (Anil Kumar Choudhary, J.) Dated:- 26.09.2025 Saroj/
