By way of this petition, the petitioners have primarily prayed for the following reliefs:-
“That the plaintiffs-defendant has not preferred any other petition against the defendant-respondent seeking same and similar relief before any competent court of law including Hon'ble Supreme Court of India. It is, therefore, prayed that the petition may be allowed and the impugned orders dated 18/09/25 passed by Learned Civil/Judge Dalhousie in case No 236/25 may be ordered to be quashed and set aside and Civil Procedure may be allowed with costs throughout and directions be issued to decide Section 10 application within time before proceeding further with trial.”

The petitioners are aggrieved by order dated 18.09.2025,

passed by learned Trial Court, in terms whereof, an application filed by the respondents herein, who are the plaintiffs before the learned Trial Court, seeking police assistance for the implementation of an
order passed by the learned Trial Court in an application filed under
Order 39, Rules 1 and 2 of the Code of Civil Procedure, dated 22.10.2024, stands allowed and the Court has directed that the SHO Police Station, Dalhousie, shall visit the spot with his team to provide assistance to the said applicants to implement order dated
22.10.2024.

Having heard learned Counsel for the petitioners and in light of the fact that the order dated 22.10.2024 is still in vogue, this Court is of the considered view that there is no infirmity in the order dated 18.09.2025, in terms whereof, police assistance stands granted.

At this stage, on the request of learned Counsel for the petitioner, this petition is disposed of with the direction that let the application, which has been filed before learned Trial Court under
Order 39, Rules 1 and 2 of the Code of Civil Procedure, be decided expeditiously so that at least, the contentions of the present petitioner can be taken care of and an appropriate order can be passed finally disposing of the application.
With these observations, these proceedings are closed. Endeavour be made by learned Trial Court to decide application

under Order 39, Rules 1 and 2 of the Code of Civil Procedure within a period of 6-8 weeks from today. Pending miscellaneous application(s), if any also stand disposed of accordingly.
