Sri.Mrutyunjay Hallikeri, learned counsel accepts notice for respondent Nos.1 to 3. 2. The petitioner is before this Court seeking for the following reliefs: a. Issue a writ or order or direction in the nature of WRIT OF MANDAMUS directing the respondents to pass an order granting the revised pay scale, arrears of revised pay scale and earned leave encashment of 120 days to the petitioner as per notification No.006/3804, dated 24-03-2023 thereby revising the pay scales of its employees with effect from 01-01-2023 as per ANNEXURE-E. b. The short grievance of the petitioner is that the representation submitted by the petitioner for revising the pay scale, arrears of revised pay scale and making payment for earned leave dated 24.03.2023 has not been considered. 4. Whenever any representation is submitted by any employee to the employer, who is a State, under Article 12 of the Constitution the same is required to be considered and necessary orders passed, either accepting or rejecting the said representation. 5. Neither of them not having been done, I pass the following: ORDER i) Writ petition is allowed. ii) A mandamus is issued directing respondents to consider the representations of the petitioner at - 4 - HC-KAR NC: 2025:KHC-D:12349 WP No. 107212 of 2023 Annexure-F series within a period of 6 weeks from the date of receipt of a copy of this order.
