With the consent of learned counsel for the parties, the matter is heard at this stage.

Under order dated 28.11.2023 (Annexure P-10), the respondents have regularized services of the petitioner w.e.f. 28.08.2016. Petitioner seeks daily wage status w.e.f.
01.01.2009. Relief has been prayed on the strength of the decisions rendered in Smt. Leela Devi Versus State of

Himachal Pradesh and others2 and Batti Devi & others Versus State of H.P. & others3. Learned counsel for the petitioner also places reliance upon office circular dated 16.03.2016 issued by the Government of Himachal Pradesh, Finance (Pay Revision) Department, on the subject ‘Grant of daily wage status to Part Time Workers on completion of 10 years of service’. Learned counsel submits that the petitioner would be content in case the respondents are directed to examine his case in light of the aforesaid judgments within a fixed time schedule. Learned Assistant Advocate General is not averse to this prayer.

Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of with a direction to the respondents/ competent authority to consider and decide the case of the petitioner afresh for conferment of daily wage status upon him in accordance with law as well as taking into consideration the above judgments and applicable office circulars/instructions by passing appropriate order, within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioner.
