J N BHUSHAN The Court made the following: THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 676 OF 2015 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the action of respondents in installing cell towers at Door No 25-2-682, Lake view Colony, Podalakuru road, 14th Street, Nellore in violation of G.O.Ms.No.380 of 2013 (MA & UD) Department, dated 01.08.2013 and despite objections from local residents as illegal and arbitrary and consequently direct the respondent to remove the cell tower and pass such other orders....” 2. Learned counsel for the Standing Counsel for the Respondent No.3 and learned counsel for the Respondent No.4 would submit that no Cell Tower is installed in the schedule premises as per instructions of Assistant City Planner, Nellore Municipal Corporation dated 03.04.2025. Therefore, the cause in this Writ Petition does not survive for an adjudication by this Court. 3. While recording the above said submission and keeping the instructions on record, the Writ Petition is dismissed as infructuous. No order as to costs.
