Heard Shri Shashank Bhushan Pandey Chanchal, learned counsel for the petitioner, learned Standing Counsel for the State-respondents No. 1 and 2 and Shri Amit Khanna, learned counsel for the respondents No. 3 and 4. The petitioner claims promotion to the post of clerk in the Nagar Palika Parishad, Thakurdwara, District Moradabad. He claims that the selection committee has already made a recommendation to that effect on 09.09.2008. Shri Amit Khanna, learned counsel for the respondents No. 3 and 4 submits that the matter requires determination of facts by the competent authority in the light of various service rules and eligibility requirements in the first instance. In the wake of preceding discussions and without going into the merits of the case, the respondent No.4-Executive Officer, Nagar Palika Parishad Thakurdwara, District Moradabad is directed to decide the representation of the petitioner regarding promotion, preferably, within a period of three months as per law from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 22.4.2025 Jaswant Digitally signed by :- JASWANT KUMAR High Court of Judicature at Allahabad
